The purchaser is entitled to notify the company that he has decided not to proceed with the purchase, without payment of a penalty and without giving reasons, within the 14 calendar days from the day following the delivery of the item or entering into the service agreement.

1. General Terms and Conditions
You agree to these general terms and conditions by using this website. These general terms and conditions apply to all transactions that are conducted online with Akzo Nobel Decorative Coatings B.V. on the website [www.sikkenssamples.com].

Please read them carefully before placing an order. Nothing in these general terms and conditions will be deemed to harm your statutory rights.

2. Product offered
Akzo Nobel Decorative Coatings B.V. offers Sikkens color samples through its website. Akzo Nobel Decorative Coatings B.V. supplies a requested color sample to potential and existing customers of Sikkens paint products. This enables you to test and compare the colors of Akzo Nobel Decorative Coatings B.V.’s Sikkens paint products in your own home or another space that might be painted. In this way you can make an even better color selection.

3. Ordering process and formation of the contract
In order to purchase one or more color samples you must first add the paint samples you want to your shopping cart. As soon as you have added the paint samples you want to your shopping cart, you must log in or create an account. You can also log in or create an account beforehand. Next you have to enter some personal and other information. If all the information has been correctly entered, you will go to an overview page. If you accept it, you can proceed to the Ogone payment module. If you have paid in the payment module, your purchase is definitive and you receive a confirmation e-mail.

4. Prices, delivery costs and payment
Unless explicitly stated otherwise, all prices are in euros and exclude VAT at the current rate. Unless explicitly stated otherwise in your shopping cart or on the overview page, all prices exclude delivery costs.

Although we do everything we can to ensure that the prices are correct, we accept no liability for obvious reproduction and printing errors or omissions.

All prices and delivery costs may be changed without prior notification.

All transactions using credit or debit cards are subject to validation checks and the approval of the card issuer. We only accept online payments through Ogone Online Collect. If the issuer of your card refuses to consent to your payment to us, we cannot be held responsible for delays in the delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder are not accepted or processed.

5. The right of withdrawal
If you do not want to go ahead with the purchase, you must return the goods to the return address given at the bottom of this document at your expense, unopened in the original packaging within 14 calendar days after delivery. Opened or used color samples are not accepted. If you exercise your right of withdrawal, the most you have to pay is the cost of returning your order. Amounts already paid we will repay as quickly as possible and in any event within 30 days after return or withdrawal.

6. Language
The purchase contract can be concluded in the language of the website where you purchase.

7. Delivery
The color sample ordered is delivered by post to addresses in the Netherlands. We do everything we can to ensure that you receive your order as soon as possible. The maximum delivery period is 30 days from the date of your order.

All goods are delivered subject to their availability. If we are not able to deliver your goods within 30 days, we notify you immediately and tell you what the expected delivery date is. In the event that we are not able to deliver your color samples within 30 days, you are entitled to cancel the non-delivered orders at any moment after you have been notified of the late delivery. If payment has already been made, you will receive complete repayment for the color sample. If we do not receive such notification, you are deemed to have accepted the articles as satisfactory.

We cannot be held responsible for any consequential loss or damage because of late delivery or non-delivery by post. In such cases our liability is limited to the value of the color samples that are proved not to have been received by you.

8. Complaints
If the color samples supplied by us are damaged during transport or do not correspond to the color samples your ordered, or if you have some other complaint, we request you to contact us as soon as possible after receipt of the color samples so that an appropriate solution may be found for your problem. Our contact details and the return address are at the bottom of this document.

9. Color deviations
It is possible that the color of a delivered color sample may deviate somewhat from the color you observed earlier on your monitor via the Akzo Nobel Decorative Coatings B.V. website. This can be caused by several factors, for example the type and settings of the monitor or the incidence of light.
It is also possible that the color of a delivered color sample may deviate somewhat from the color of the paints supplied by Akzo Nobel Decorative Coatings B.V. This can be caused by different printing techniques used for the color samples. Such deviations are outside the scope of Akzo Nobel Decorative Coatings B.V.'s influence and therefore cannot be grounds for discounts, rejection, dissolution, compensation etc.

10. Limitation of liability
We are not liable for indirect loss or damage or consequential loss or damage (such as but not limited to loss of time, moral and emotional damage, loss of opportunity, loss of data or loss of profit). Our contractual and extra-contractual liability is limited to your purchase price.

11. Intellectual property
All intellectual property rights to the color samples that have been sent remain with Akzo Nobel Decorative Coatings B.V. and/or its affiliated companies or its licensors. Without prior written agreement from Akzo Nobel Decorative Coatings B.V., it is not permitted to use color samples for commercial purposes, including reproducing, selling, distributing, publishing or otherwise disclosing or copying.

12. Force majeure
We are not responsible for cases of force majeure, i.e. situations that make it impossible or very difficult (or generate high costs) to fulfill our obligations under this contract. Such situations include natural disasters, war or risk of war, whether or not the Netherlands is directly involved, complete or partial mobilization, state of siege, revolt, sabotage, flooding, fire or other types of destruction in factories or warehouses and lock-outs; and subcontractors/producers that – for whatever reason – fail entirely or partly to fulfill their obligations in respect of the vendor. In the event of force majeure we are entitled to dissolve the contract without being obliged to pay compensation.

15. Applicable law and competent court
All contracts are subject to and interpreted in accordance with the law of the Netherlands, and all disputes between us will be submitted exclusively to the court in The Hague.
